4. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information about your business and marketing needs
  • Provide timely access to necessary accounts, systems, and resources
  • Respond to requests for information, approvals, or feedback in a timely manner
  • Make payments according to the agreed-upon schedule
  • Use our services in compliance with all applicable laws and regulations

5. Payment Terms

Payment terms will be specified in your service agreement. Unless otherwise stated:

  • Services are billed monthly or according to the agreed-upon schedule
  • Payment is due within the timeframe specified in your agreement
  • Late payments may result in service suspension or termination
  • All fees are non-refundable unless otherwise specified in writing

6. Intellectual Property

All content, materials, and intellectual property created by CreativeIQ as part of the services, including but not limited to website designs, content, graphics, and marketing materials, remain the property of CreativeIQ until full payment is received. Upon full payment, ownership transfers to the client as specified in the service agreement.

7. Confidentiality

CreativeIQ will maintain the confidentiality of all proprietary information shared by clients. We will not disclose, use, or reproduce any confidential information except as necessary to perform the services or as required by law.

8. Performance Guarantees

While we work diligently to achieve the best possible results for our clients, we do not guarantee specific rankings, traffic numbers, conversion rates, or other marketing metrics. Results may vary based on industry, competition, and other factors beyond our control.

9. Limitation of Liability

To the maximum extent permitted by law, CreativeIQ Digital Marketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

10. Termination

Either party may terminate the service agreement with written notice as specified in the agreement. Upon termination, you will be responsible for payment of all services rendered up to the termination date. CreativeIQ reserves the right to terminate services immediately for non-payment or breach of these Terms.

11. Third-Party Services

Our services may integrate with or depend on third-party platforms, tools, or services (such as Google, Facebook, or CRM systems). We are not responsible for the availability, functionality, or terms of service of these third-party services.

12. Changes to Terms

CreativeIQ Digital Marketing reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
